Terms of Service

These Terms of Service ("Terms") govern your access to and use of GetDemand.ai ("the Platform"), operated by GetDemand ("we," "us," or "our"). By creating an account or using the Platform, you agree to these Terms in full.

1. Service Description

GetDemand.ai is an AI-powered sales intelligence platform that helps manufacturers, exporters, and distributors discover potential buyers, automate outreach, generate quotes, and manage sales pipelines. The Platform uses AI agents that scan publicly available data sources including customs records, government tenders, trade directories, and B2B marketplaces.

2. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old and have the authority to enter into these Terms on behalf of your organization.
  • You must notify us immediately at security@getdemand.ai if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

  • Use the Platform to send unsolicited bulk email (spam) or violate CAN-SPAM, GDPR, or other applicable anti-spam laws.
  • Upload malicious content, malware, or attempt to compromise Platform security.
  • Scrape, crawl, or extract data from the Platform beyond normal use of its features.
  • Use the Platform for any illegal purpose, including but not limited to fraud, harassment, or export control violations.
  • Impersonate another person or entity in communications sent through the Platform.
  • Resell, sublicense, or redistribute access to the Platform without written permission.
  • Circumvent usage limits, rate limits, or access controls.

4. Your Data

  • Ownership: you retain all rights to the data you upload to or create within the Platform, including product catalogs, contact lists, email content, and pipeline data.
  • License to us: you grant us a limited license to process your data solely to provide and improve the Platform. We do not use your proprietary data to train AI models for other customers.
  • Export: you may export your data at any time through the Platform or by contacting support.
  • Deletion: upon account termination, your data will be deleted within 30 days. You may request an export before deletion.

5. Intellectual Property

  • The Platform, its design, code, AI models, and documentation are owned by GetDemand and protected by intellectual property laws.
  • AI-generated content (email drafts, quotes, lead research) created for you through the Platform is yours to use without restriction.
  • Lead discovery data sourced from public databases is provided as-is. We do not claim ownership of publicly available business information.

6. Payment and Billing

  • Paid plans are billed monthly or annually, as selected at checkout.
  • Payments are processed securely by Stripe. We do not store credit card information.
  • Prices are listed in USD unless otherwise stated. Applicable taxes will be added at checkout.
  • You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.
  • Refunds are available within 14 days of initial purchase for annual plans. Monthly plans may be cancelled at any time but are not refunded for partial months.
  • If payment fails, we will attempt to charge your payment method for up to 7 days. After that, your account may be downgraded to the free tier.

7. Free Trial

We may offer a free trial period. No credit card is required to start a trial. At the end of the trial, your account will be downgraded to the free tier unless you subscribe to a paid plan. Trial data is preserved.

8. Service Availability

  • We aim for 99.9% uptime but do not guarantee uninterrupted service.
  • Planned maintenance will be communicated at least 24 hours in advance when possible.
  • Third-party data sources (customs databases, tender portals) may experience downtime outside our control.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee the accuracy, completeness, or timeliness of lead discovery data, AI-generated content, or buyer signals.
  • Our total liability for any claim arising from your use of the Platform is limited to the fees you paid us in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost deals, or business interruption.

10. Indemnification

You agree to indemnify and hold harmless GetDemand from claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights, including email recipients' rights under anti-spam laws.

11. Termination

  • You may close your account at any time from your account settings or by emailing support.
  • We may suspend or terminate your account if you violate these Terms, with notice when reasonably possible.
  • Upon termination, your right to use the Platform ceases immediately. You may request a data export within 30 days of termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which GetDemand is incorporated, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration, except for claims for injunctive relief.
